Agreement

By accessing or using Randomtrip websites, apps, or services (the Services), you agree to these Terms of Service. If you do not agree, do not use the Services. We may update these Terms; the updated version will be posted here, and continued use may constitute acceptance as allowed by law.

What Randomtrip provides

Randomtrip is a marketplace and technology layer that helps travelers express preferences and book surprise-travel experiences curated by independent Trippers. Unless stated otherwise, Trippers are responsible for designing and delivering the travel experience; Randomtrip facilitates discovery, booking, communication, and payment processing.

Eligibility and accounts

You agree that:

• You are legally able to enter a binding contract in your jurisdiction.
• Registration information is accurate and kept up to date.
• You are responsible for safeguarding your password and for activity under your account.
• You will notify us promptly of unauthorized access.

Bookings, prices, and payments

When you purchase through Randomtrip:

• Prices are displayed in the currency shown at checkout unless stated otherwise.
• Payment is processed by Mercado Pago or another processor we designate; their terms and privacy policy also apply.
• You authorize us and our payment partners to charge your selected payment method for the total shown, including applicable taxes and fees when quoted.
• Trip details, blackout dates, inclusions, and exclusions are described in the offer or confirmation. The surprise destination model means some specifics are revealed according to the product rules.

Traveler conduct

You must not:

• Use the Services for unlawful, harassing, or discriminatory purposes.
• Attempt to scrape, hack, reverse engineer, or overload our systems.
• Circumvent payments, fees, or identity checks.
• Misrepresent health, safety, or accessibility needs in a way that endangers you, Trippers, or third parties.
• Resell or commercially exploit listings without authorization.

Trippers and third parties

Trippers and local operators are independent parties. Randomtrip does not control every on-the-ground decision. Their performance is their responsibility subject to our Tripper agreements and consumer law. Carriers, hotels, and activity providers may have their own terms and conditions of carriage or stay.

Intellectual property

Content on the Services (brand, design, text, graphics, video, software) is owned by Randomtrip or licensors. You receive a limited, non-exclusive license to use the Services for personal, non-commercial trip planning unless we agree otherwise in writing.

Disclaimers

Travel involves inherent risks. The Services are provided as is and as available to the fullest extent permitted by law. We do not guarantee uninterrupted access or that every trip will match subjective expectations of surprise, though we strive for high quality. Maps, photos, and descriptions are illustrative.

Limitation of liability

To the maximum extent permitted by applicable law, Randomtrip and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Services is limited to the amount you paid for the specific booking giving rise to the claim in the twelve (12) months before the event, except where liability cannot be limited by law (including gross negligence or willful misconduct).

Indemnity

You will indemnify and hold harmless Randomtrip from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or violation of third-party rights.

Suspension and termination

We may suspend or terminate access for breach of these Terms, risk, fraud, or legal requirements. You may stop using the Services at any time. Provisions that by nature should survive (liability limits, indemnity, governing law) survive termination.

Governing law and disputes

Unless mandatory consumer rules in your country require otherwise, these Terms are governed by the laws applicable to Randomtrip's operating entity without regard to conflict-of-law rules. Courts or arbitration in that jurisdiction may have exclusive venue, except where consumers have non-waivable rights to sue in their home courts.
